If you should need a trust, the trust document is intended as a way to avoid the cost and delay of probate for your family after your death.  For example, if certain assets, such as real estate were transferred into the trust, your trustee should be able to distribute your estate without having to go through Probate.  For some of you who have significant assets or other special concerns,  a more complicated trust may be necessary, not only to avoid probate but also to minimize the amount of any estate or federal taxes payable by your estate, or to address such concerns.

 

If you choose a simple will, it may be because you are primarily interested in naming a guardian for underage children or in simply stating to whom you wish to give your property after you die. However, a will in and of itself will not accomplish the goal of avoiding probate.
